- §1 Definitions

YassDance Studio or Studio – YassDance & Fitness Studio Yassel Llanos Barrenechea, NIP 1231553828, REGON 528209085; 02-796 Warszawa, 10/U5 Dembego St.;
Classes – educational group dance and fitness classes conducted by the Studio following the current offer available in the Schedule, including special classes constituting an additional occasional offer;
Lessons – individual dance lessons or personal training organized and conducted by the Studio;
Participant – a person participating in Classes or Lessons;
Instructor – a person conducting Classes and Lessons;
Employee – Instructor and any person working for YassDance Studio;
Schedule – schedule of Classes available in the Fitssey application, on the Studio's Website and at the Reception;
Reception – a place in the Studio where each Participant, before the Classes or Lessons, is obliged to: (1) verify their identity to confirm attendance at the Classes or Lessons, (2) sign up for the Classes or Lessons through the Fitssey application (unless they did it earlier), and in some cases (3) pay a fee;
Room – the place where Classes and Lessons are held at 10/U5 Dembego St., Warszawa;
Price list – the current price list of services offered by the Studio available on the Studio’s Website, in the Fitssey application and at the Reception;
Studio's Website – www.yassdancestudio.com.
Pass – a personalized package of purchased Classes or Lessons following the Price list;
Partner Cards – partner cards indicated in the Price list;
Parties – YassDance Studio and the Participant;
Contract – a legal relationship between the Parties resulting from signing up for Classes or Lessons and – accepting the content of these Regulations by the Participant; the subject of the Contract is the provision of services by YassDance Studio following the choice made by the Participant when purchasing a specific Pass or a single entry to Classes or Lessons;
Regulations – this document, which is a set of rules relating to the services provided by YassDance Studio and regulating the terms of the Contract, which is available on the Studio Website, in the Fitssey application and at the Reception;
Privacy Policy – a document providing Participants with information on what personal data is collected and for what purpose and how it will be used, which is available on the Studio’s Website, in the Fitssey application and at the Reception;
Force majeure – extraordinary and unforeseeable circumstances beyond the control of YassDance Studio, the consequences of which could not be avoided despite the exercise of due diligence, and which disrupt or prevent the implementation of the Contract.
- §2 General Regulations

1. Classes are held on the dates and in the rooms specified in the Schedule available on the Studio’s Website, the Fitssey application and at the Reception.
2. Classes and Lessons are educational and consist of a theoretical and practical part, based on performing movement exercises to voice commands. They take place in a closed, limited number of participants, which excludes the public nature of any content played.
3. The condition for participating in Classes and Lessons and obtaining the status of a Participant is the written or electronic acceptance of the content of the Regulations and the Privacy Policy, as well as payment for the Classes or Lessons by purchasing a single entry or a Pass. Ignorance of the Regulations does not exempt one from compliance with them.
4. Each person staying at the Studio must comply with the provisions of the Regulations and have a valid title to participate in Classes or Lessons.
5. YassDance Studio is private property and cannot be considered a publicly accessible place or public space. Only persons registered for classes are allowed on the YassDance Studio premises.
6. The Studio does not insure participants against accidents and is not responsible for them. Persons who want to be insured in the event of an incident occurring during the Participant's stay at the Studio should purchase appropriate insurance on their own.
7. By accepting the Regulations, the Participant declares that his health condition allows to participate in the Classes and Lessons offered by the Studio, which he/she will attend at his/her own risk and that he/she does not take any medications that may affect his/her physical and mental abilities in a way that prevents or making it difficult for him to participate in Classes and Lessons. Otherwise, it is not possible to participate in Classes and Lessons.
8. YassDance Studio is not responsible for injuries and accidents during Classes or Lessons resulting from participation in Classes or Lessons and failure to follow the Instructor’s instructions.
9. Recording and disseminating via photos, films or audio tracks any activity undertaken on the premises of YassDance Studio without the consent of the Employee is prohibited.
10. Each Participant is obliged to:
a. participate in Classes and Lessons wearing shoes that have been changed after entering the Studio and which do not damage or dirty the floor;
b. behave on the premises of the Studio, in particular when participating in Classes and Lessons in a way that does not disrupt their course and comply with the Instructor's instructions;
c. comply with the ban on smoking cigarettes and other tobacco products, bringing in and consuming alcoholic beverages and intoxicants, bringing in animals, bicycles and other similar equipment, and bringing in objects that may pose a threat to life and health.
Suppose the Participant fails to comply with the above-mentioned rules, the Employee has the right to exclude the Participant from participating in Classes and Lessons and demand that they leave the Studio’s premises. In such a situation, the Participant is not entitled to request a refund of the fee for the Classes or Lessons (as applicable).
11. YassDance Studio is not responsible for items left or lost on its premises if they have been left unattended or in places not designated for this purpose. The designated place for leaving things is the locker located in the women's and men's changing rooms, respectively. YassDance Studio recommends taking valuables with you to the Hall.
12. It is recommended to arrive 15 minutes before the scheduled start of the Classes or Lessons to change shoes and complete formalities (i.e. confirming identity to confirm attendance at the Classes or Lessons, possibly registering for the Classes or Lessons, or paying the fee). Attendance at the Classes is confirmed no later than 5 minutes before the start of the Classes. Failure to confirm attendance on this date may result in the inability to participate in the Classes.
13. The Studio conducts two types of Classes for adults: educational artistic group dance classes and educational sports group fitness classes, as well as educational artistic group dance classes for children and adolescents. All dance classes for adults are marked in the Schedule with the letter (D) (in Polish (T)), and fitness classes with the letter (F), while dance classes for minors are offered within YassDance Junior Academy and are marked in the Schedule with letters (JA). Dance classes are conducted in the form of educational courses. Courses are divided according to dance style and advancement level.
14. Fitness classes last 50 minutes, dance classes for adults last 55 minutes and dance classes for minors last 75 minutes unless the Schedule clearly states otherwise. Lessons last 60 minutes.
- §3 Registration, conclusion of the Contract and organization of Classes and Lessons

1. Registration for Classes can be made using the Fitssey application:
a. by the Participant through the Schedule,
b. by phone: + 48 884420308,
c. via e-mail: yassdancestudio@gmail.com.
The Participant can make a cyclical or one-time registration. Registration for Lessons takes place on terms agreed individually between the Studio and the Lesson Participant.
2. Signing up for Classes involves the obligation to pay for the selected service.
3. When registering for dance classes, the Participant should familiarize themselves with their levels and degrees of advancement as described on the Studio's Website.
4. The Contract comes into force when the Participant pays for the selected Classes or Lessons offered by the Studio or purchases any Pass.
5. As only Participants who have previously enrolled, paid the fee and registered their attendance can take part in the Classes, a visit to the Reception is required before each Class to complete the above formalities.
6. Each Pass is personal and has a specific period and scope of validity.
7. In the case of dance classes, registration for a given course is required, which means that the Pass applies to a specific course/courses.
8. YassDance Studio does not offer services related to public music playback. Music accompanying classes is only auxiliary, and its playback is for personal use by the Instructor as part of the teaching methodology. Classes are not dependent on playing music. The basis of the methodology of classes is teaching movement techniques and physical exercises. Instructors use voice commands, clapping, rhythm and movement demonstration, which is the basis of classes.
9. Classes and Lessons conducted by Instructors constitute a work within the meaning of the Copyright and Related Law Act and are covered by all rights arising from this Act.
10. If too few Participants sign up for a given Class, YassDance Studio has the right to cancel, suspend or terminate it, of which it will immediately inform the Participants, and the unused fee will be refunded or transferred to other Classes, following the Participant's will.
11. The classes are intimate for a strictly limited number of participants, which is to ensure comfort and safety during the classes. The possibility of participating in Classes is determined by the moment of registration for a specific class in the Fitssey application, combined with timely payment for the Classes. Priority entry to Classes is given to people who have purchased YassDance Studio passes.
12. For special classes, registration and reservation of places confirmed by advance payment are required. In the event of failure to pay the advance payment at least 5 days before the start of the Classes, YassDance Studio reserves the right to cancel the registration in the Fitssey application.
13. In exceptional situations beyond the control of YassDance Studio (including during holidays or the indisposition of the Instructor), the Instructor conducting specific Classes may be changed or replaced by another one with equal or higher qualifications and skills. The decision to replace and select a new Instructor rests with the Studio and cannot be questioned. In the event of random events, the Studio has the right to change the place of conducting the Classes, about which it will inform the Participants in advance via the Fitssey application. If the Studio is unable to find a replacement for an absent Instructor, the Classes may be canceled. In such a case, active Passes will be automatically extended by the number of days corresponding to the missed Classes.
- §4 Payment system

1. YassDance Studio allows payment:
a. in cash, with BLIK or by payment cards at the Reception;
b. traditional transfer (in this case, it is necessary to provide the name and surname of the Participant and the type of paid Pass and send the transfer confirmation to the following address: yassdancestudio@gmail.com); the account number can be found in the "contact" tab on the Studio’s Website;
c. using the Fitssey application if this function is available.
2. YassDance Studio reserves the right to change the Price list. Information about the planned change in prices for the services provided is announced on the Studio’s Website and at the Reception. The new Price list does not apply to services paid before it entered into force. The rules regulated in this point do not apply to situations arising from force majeure.
3. YassDance Studio has the right to prepare an individual offer of services upon special request (e.g. closed groups, choreographic groups).
4. The Participant may pay for a single entry to Classes or Lessons or purchase one of the Passes, following the applicable Price list. It is also possible to use Partner Cards according to the rules specified in the Price list.
5. Class passes for adult Participants apply to a specific number of entries (from 4 entries upwards) to specific fitness, fitness-yoga or dance classes, marked appropriately in the Schedule or Lessons, and can be used by the participant within 30 days from the moment of using the first entry.
6. The fee paid by the Participant for Classes (single entry or as part of a Pass) will be refunded only in the following situations:
a. The Classes will not start due to too few participants,
b. The Classes will be canceled due to too few participants.
In such a situation, a refund will be made based on a written request submitted by the Participant, along with proof of purchase, to the account specified by the Participant. The refund amount will be proportional to the number of entries used from the purchased pass. This means that the fee paid will be divided by the number of entries covered by the pass, and then the refund amount will be calculated based on this (the number of entries used will be subtracted from the total paid amount; for example, a 4-entry pass cost 120 PLN, but the Participant used 2 entries, so the refund amount is 60 PLN).
7. If the Participant requests a refund based on the contract termination and resignation from Class participation, YassDance Studio has the right to deduct actual costs incurred, including those related to booking the Instructor's time and mobilization, and booking the room. The refund calculation for unused Classes under the Pass will be based on the principle of converting the used Classes into single-entry prices, as by purchasing the Pass, the Participant benefits from a discount granted for prepaid classes. Therefore, in the event of a refund request, the used classes will be treated as single-entry costs.
8. For adult Classes, Participants have the right to cancel their participation in a Lesson or Class for which they are registered in the Fitssey app (signing up for a Class through the Fitssey app is equivalent to making a reservation for that Class) no later than 8 hours before the scheduled start time. If cancellation occurs later, the Participant will be responsible for the cost of the Class or Lesson according to the Price list, or the full cost will be deducted from the purchased Pass (these include the costs of booking the room, the instructor's time, and their mobilization). If the Participant does not have an active pass and does not cancel their Class reservation, the cost will be deducted from the next purchased pass. Participants may cancel their reservation once for a paid single entry or a 4-entry pass; twice for an 8- or 10-entry pass; three times for a paid 12-entry pass; and four times for a paid 16-entry pass. Participants who do not have an active membership and cancel three or more consecutive sessions may be blocked from booking classes for the next seven days. Participants using Partner Cards registered for specific classes in the Fitssey app, if they fail to cancel their attendance at least eight hours before the start of the Class, will be required to pay the fee for a single class in accordance with the Price list before their next session and use of their Partner Card, or this amount will be deducted from the deposit paid in their Fitssey Wallet, if this option is available. Class cancellations are made via the Fitssey app and Participants are required to do so individually in their profiles.
9. To guarantee a place in special classes, a deposit of PLN 50 must be paid. The deposit is non-refundable in the event of failure to attend the Class. The deposit may be transferred to another person.
10. The fee for the classes applies only to the educational service in the field of movement and dance technique or fitness exercises but does not include services related to playing music because it is not an integral part of the Classes or Lessons.
- §5 Regulations for minors’ Classes within YassDance Junior Academy

1. The guardian of a minor (parent or legal guardian) concludes the Agreement on their behalf and undertakes to comply with the Regulations and takes responsibility for observing the Regulations by the minor. The guardian undertakes to set up an account for themselves and the related person (child) in the Fitssey application, which will enable the registration of the Participant's entries to classes in accordance with the purchased Pass and at the same time consents to the installation of the Fitssey application by the child and its use to register entries to Classes or will manage the Classes themselves.
2. Classes within the Junior Academy last 75 minutes and are marked in the Schedule with letters (JA). All passes are valid for 28 days for 4, 8 or 12 consecutive Classes (depending on the type of Pass purchased) for a given (chosen) dance Class (course).
3. Purchased Passes are not subject to refunds or extension of the time of use, except in the following situations:
a. the class group was not created or was dissolved due to too few Participants (in this case, a refund is due in an amount equivalent to the unused entries),
b. the Schedule has been changed (if the new Schedule does not suit the Participant, they are entitled to a refund equal to the unused entries),
c. Classes have been canceled due to the Studio’s fault (in such a case, the Pass is extended by the appropriate number of days),
d. The Participant has suffered a serious illness lasting over 14 days and can present a medical certificate confirming their inability to participate in the dance Classes (in such a case, the Pass is extended by the number of days specified in the medical certificate after the first 14 days of inability to participate in the Classes).
4. The rules for withdrawing from the contract and requesting a refund for unused entries are regulated in Article 6 and Article 4, point 7 of these Regulations, respectively. Classes that the Participant cannot attend must be canceled via the Fitssey app at least 8 hours in advance. If the Participant does not have an active pass and does not cancel the Class reservation, the fee will be deducted from the next purchased pass.
5. The Studio reserves the right to change the Instructor and, in the event of illness or other events, to temporarily replace the permanent Instructor with another. In such cases, there is no refund for the unused Pass.
6. Generally, classes do not take place on days free from school, i.e., primarily during vacations, winter holidays and holiday breaks. If most Participants express their willingness to take part in Classes during the above-mentioned periods, classes may be held by mutual consent (of the Studio and Participants). The Studio informs about days free from classes via the Fitssey application.
7. To guarantee the place in the group, payment for the Passes must be made in advance – by bank transfer or BLIK (details available on the website in the Contact section) or via the Fitssey app. Payments can also be made at the Studio Reception desk by credit card or cash. In this case, the place in the group cannot be guaranteed.
- §6 The right to withdraw from the Contract and Complaints

1. The Participant has 14 days to withdraw from the Contract when purchasing a Pass or single entry remotely, unless the service (use of the Pass or single entry) has started before this deadline.
2. The participant has the right to withdraw from the contract at any time during its duration.
3. The Participant is obliged to submit a declaration of withdrawal from the Contract in written form (send it to the address of the Studio's registered office or leave it at the Reception) or electronically (send it to the following address: yassdancestudio@gmail.com).
4. A declaration of withdrawal from the Contract should contain the following elements:
a. name and surname and e-mail address or correspondence address,
b. date of submission of the declaration,
c. information about the type of service from which you waive (type of classes, type of purchased Pass or single entry along with the date of purchase),
d. the request in connection with the withdrawal from the contract – a refund of unused funds or a transfer of unused funds to another pass,
e. account number and all data necessary to complete the refund in the case of making such a choice.
5. In case of a refund request, proof of purchase must be provided.
6. The refund of the paid amount will be made no later than 14 days after receiving the declaration of withdrawal from the Contract.
7. Complaints and opinions related to the services provided by YassDance Studio can be submitted in written form (sent to the address of the Studio's headquarters or left at the Reception) or electronically (sent to the following address: yassdancestudio@gmail.com).
8. The complaint should include the following elements:
a. name and surname and e-mail address or correspondence address, depending on the preferred method of response by YassDance Studio,
b. date of submitting the complaint,
c. information about the reason for the complaint - detailed description,
d. information regarding the expected manner of considering the case.
9. The complaint will be considered within 14 days of its receipt. The person submitting the complaint will be informed about the method of considering the complaint via the e-mail address indicated in the complaint or to the correspondence address.
10. Complaints not containing any of the elements indicated in point 6 of this paragraph will not be considered.
- §7 Final Provisions

1. In matters not regulated in these Regulations, the provisions of the Civil Code will apply.
2. In the event of Force majeure, YassDance Studio reserves the right to suspend or discontinue the services it provides for the duration of events related to Force majeure or its consequences, or to switch to online Classes, the details of which will be presented to the Participants for approval before starting Classes in this form.
3. The Studio notifies Participants of all circumstances related to the services provided via the Fitssey application or the Studio’s Website unless these Regulations provide otherwise.
4. Classes organized by YassDance Studio are not public events and do not constitute a form of public performance of music within the meaning of copyright law. By signing up for classes, participants accept that participation in them is not dependent on the presence of background music.
5. Participants are informed about changes to the Regulations via the Fitssey application.
6. The Regulations in an additional language version (English) are available on the Studio's Website. In the event of any discrepancies between the versions, the version prepared in Polish will prevail.
7. The Regulations come into force on 1st December 2025.
